Dilapidation is the difference in the condition of a tenanted property, residential or commercial, between the beginning of the lease and the performance of lease responsibilities when the tenant leaves the property. If a rented property has not been returned to the owner in the condition agreed within the original lease, then an assessment by an experienced professional is often required. Gardner & Co will provide the appropriate report which will specify the repairs or maintenance for which the tenant has financial responsibility, and this is often a quicker and less confrontational means of resolving issues than involving the legal processes.

An interim dilapidation assessment will often take place during a long lease period and is designed to maintain the property in good order. Gardner & Co will usually be asked by the landlord to attend and carry out a survey to identify elements of disrepair with the intention of preventing further deterioration in accordance with the lease.

Gardner & Co are experienced at undertaking condition surveys according to differing client objectives. At its most basic level it is a snapshot of the condition of a building at a particular time and will establish any maintenance requirements and necessary repairs.

Our advice for tenants entering into any lease agreement is to fully understand their obligations when the lease period ends. Regardless of the Landlord’s inventory and condition report it is often useful for the Tenant to conduct their own inventory and assessment at the outset as well. This will need to be undertaken by an experienced assessor such as Gardner & Co and can be used if there is an end of tenancy dispute concerning the original condition.
